In the face of discipline, Abbotsford lawyer Gerald E. Palmer has resigned his membership with the Law Society and is prohibited from re-applying to become a lawyer for five years.
Palmer admitted he caused trust shortages by improperly withdrawing client trust funds when his trust accounting records were not current and there were insufficient funds to support the withdrawals. Palmer also failed to immediately eliminate the trust shortage, report the shortages to the Executive Director and maintain accurate accounting records. During the course of representing different clients in real estate matters, Palmer failed to honour a trust condition, answer inquiries with reasonable promptness, serve his clients in a timely and diligent manner and provide the expected quality of service.
In accepting the consent agreement, the Law Society took into consideration an Agreed Statement of Facts and Palmer’s professional conduct record.
Palmer has provided an undertaking that he will not practice law, and will not apply for reinstatement in BC or any other Canadian law society for a minimum of five years.
