The Law Society of BC has been asked to remind lawyers to indicate in the preamble and the jurat of an affidavit whether the affiant was swearing or affirming that the contents of the affidavit were true. The issue appears to flow from the use of boilerplate language, such as “I, [affiant], [address], swear (or affirm),” and forgetting to indicate which method the affiant has chosen.
For more information on the responsible execution of affidavits, lawyers are encouraged to consider Appendix A – Affidavits, Solemn Declarations and Officer Certifications and to contact the Practice Advisors with any questions.
