The Law Society of BC is seeking a permanent, full-time Manager in our Trust Assurance department. The Law Society has a mandate to protect the public interest. This is met, in part, through the effective and efficient regulation of trust funds handled by BC law firms. The Manager, Trust Assurance assists the Director in management of the Compliance Audit program and the oversight of serious conduct concerns identified by the audit team, and supervision of several Auditors and Audit Analysts to ensure the department’s mandate of completing the audit cycles are met, while also identifying and referring lawyers with serious professional conduct concerns to Professional Conduct for further investigation.

The duties of the position include:
  • Overseeing the Compliance Audit program by creating a positive work environment to achieve high performance from the Auditors and the Audit Analysts to ensure that the program mandate and goals are met.
  • Working with the Director to develop, implement and administer the Compliance Audit program, policies, procedures and communications to ensure an environment of continuous improvement is maintained.
  • Leading, training, coaching, mentoring and inspiring Auditors to identify serious conduct concerns of lawyers’ books, records and accounts, and aiding in the analysis and documentation of the conduct concerns.
  • Reviewing the Auditor’s findings and law firm records for non-compliance with the Legal Profession Act, Law Society Rules and the Code of Professional Conduct for British Columbia and for other potential serious conduct concerns.
  • Advising the Director if audit findings identified serious concerns that warrant immediate action and presenting those findings to the Professional Conduct management.
  • Drafting detailed memos to refer serious audit findings to the Professional Conduct department and by providing oral evidence supporting the referral, when required.
  • Ensuring that the audit program’s operating metrics and key performance measures are met, including individual Auditor’s performance metrics.
  • Conducting effective one-on-one and periodic group meetings with Team Leaders, Auditors and Audit Analysts regarding serious conduct concerns.
  • Interviewing and screening new Auditors, and assisting the Director with feedback on candidate selection, in addition to evaluating current hiring processes and advising the Director of improvements that could be made.
  • Conducting annual performance reviews with select team of Auditor and Audit Analysts, in addition to conducting detailed performance improvement plans to correct deficiencies, provide constructive feedback and communicate expectations and goals.
  • Working with the Team Leaders to develop and implement a robust training program for new Auditors.
  • Working with the Audit Analysts to ensure law firms have provided the required records for compliance audits and communicate with the law firm on the outstanding records; when necessary, advise the Director if a potential notice of suspension of the lawyer’s membership should be issued.
  • Evaluating current rules for improvements that could be made, gathering data to draft memo on proposed rule change, liaise with Policy and other Law Society departments.
  • Collaborating with other Law Society staff and external individuals to create guidance material for law firms on anti-money laundering.
  • Staying current with the relevant rules in the Legal Profession Act, the Law Society Rules, the Code of Professional Conduct for British Columbia, various sections of the Wills, Estates and Succession Act, Real Estate Act, Land Title Act, Securities Act and Mortgage Brokers Act and publications from the Federation of Law Societies of Canada with an emphasis on the anti-money laundering landscape.
  • Such other duties as the Director, Trust Assurance may require.
Qualifications
  • Chartered Professional Accountant designation with CPABC and Certified Anti-Money Laundering Specialist designation with ACAMS is required. An additional designation of CFE or CIA is desired.
  • Ten years of management experience; preferably with public practice, regulatory or internal audit. In depth knowledge of Division 6 – Financial Responsibility, Division 7 - Trust Accounts and Other Client Property, Division 8 – Unclaimed Trust Money, Division 11 – Client Identification and Verification Rules, various sections of the Legal Profession Act, Code of Professional Conduct for British Columbia, Wills, Estates and Succession Act, Real Estate Act, Land Title Act, Securities Act and Mortgage Brokers Act, as well as knowledge of various law firm areas of practice.
  • Excellent leadership, analytical, innovating and problem-solving skills are required. 
  • In addition, strong interpersonal, communication and team building skills and the ability to prioritize and manage workload of others to achieve the expected performance results. 
  • Requires excellent written communication, including the ability to write letters and memos that are impartial, direct, clear and concise. 
  • Must demonstrate initiative, superior organizational, attention to detail and the ability to prioritize and manage both their workload and the workload of others to achieve the expected performance results.
The salary range for this position is $138,176 to $150,191.
